العدالة الانتقالية Transitional Justice

الجُهود الرامية إلى مُعالجة انتهاكات حُقوق الإنسان في حقبة سياسيّة مُعيّنة، وذلك في أعقاب اندلاع ثورة بالبلاد أو حدث جلل يستدعي تكثيف الجهود لمُعالجة آثار هذه الانتهاكات جنباً إلى جنب مع المسارين القضائي وغير القضائي. العدالة الانتقاليّة تشمل المُلاحقات الجنائيّة ولجان المُصارحة وكشف الحقيقة، وتقديم تعويضات وإعادة هيكلة منظومة الأمن.

ويشير هذا المصطلح إلى الجهود المبذولة لمعالجة إرث انتهاكات حقوق الإنسان واسعة النطاق التي لا يمكن للهياكل القضائية وغير القضائية القائمة معالجتها بالكامل. تضمنت ردود الحكومة الملاحقات الجنائية، ولجان الحقيقة، والتعويضات، والعدالة بين الجنسين، وإصلاح النظام الأمني، وإحياء الذكرى، وجهود المصالحة الأخرى.

Efforts that aim to treat human rights violations in a particular political era, following an outbreak of a revolution in the country or a major event that calls for intensifying efforts to address the effects of these violations along with the judicial and non-judicial tracks. Transitional justice includes criminal prosecutions, frankness commissions, revealing the truth, providing compensation and restructuring the security system. The term refers to efforts to address the legacy of widespread human rights abuses that the existing judicial and non-judicial structures cannot fully address. Government responses included criminal prosecutions, truth commissions, reparations, gender justice, security reform, memorialization, and other reconciliation efforts.
