الشرعية Legitimacy

الحالة التي يتم التزام المعايير فيها بموضوعيّة وشفافية من قبل الدولة أو من قبل مجموعات الضّغط على حد سواء، مثال ذلك أن يتم إجراء الانتخابات بنزاهة وشفافية ووفق إجراءات عادلة تسمح بوجود تنافسية وتعدُّديّة حقيقيّة أمام المُرشّحين. والعكس صحيح، كُل إجراء يتم فيه التزام الشّكل فقط دون التّركيز على استيفاء الجوهر؛ فهو قانوني لكنه يفتقد إلى شرعيّة، كالانتخابات التي تُجرى بناءً على شروط وإجراءات تعجيزيّة في قواعد الترشُّح.

The situation where the criteria are adhered to objectively and transparently by the state or by pressure groups alike, for example, conducting the elections with integrity, transparency, and according to fair procedures that allow for real competition and pluralism for the candidates. And vice versa, Every procedure in which only the form is adhered to, without focusing on the fulfillment of the substance; is legal, but it’s not legitimacy, like elections that are held based on impossible conditions and procedures in the candidacy rules.
